Terms of Service

SpinMixPro is a web application that generates class playlists for fitness instructors, based on user-defined blueprints, BPM rules, and genre preferences. The service uses a deterministic rules engine and a shared song database to assemble playlists.

SpinMixPro is operated by balacoda GmbH (see Imprint for full details).

By creating an account or using SpinMixPro, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

We reserve the right to update these terms at any time. Continued use after changes constitutes acceptance of the updated terms.

• You must be at least 16 years old to create an account
• One account per person — accounts are non-transferable
• You are responsible for maintaining the confidentiality of your password and for all activity under your account
• You must provide accurate and truthful information when creating your account
• You must notify us immediately of any unauthorised use of your account

You agree not to:

• Scrape, crawl, or systematically extract data from SpinMixPro
• Resell, sublicense, or commercially distribute SpinMixPro's output or functionality without our written permission
• Attempt to reverse-engineer, decompile, or access the source code of the service
• Use the service to infringe third-party intellectual property rights
• Upload malicious content or attempt to compromise the security of the service
• Create multiple accounts to circumvent free-tier limits

Free accounts include:

• 5 playlist generations per calendar month
• 1 playlist per generation
• 1 saved blueprint
• Up to 3 custom blocks
• Song preview (30-second Deezer clips)
• Export playlist as text or CSV

Free tier limits may be changed with 30 days' notice.

SpinMixPro offers paid subscriptions processed via Stripe:

• Pro Monthly — CHF 9.00 per month
• Pro Yearly — CHF 89.00 per year (approximately 18% savings)

Billing

• Subscriptions are billed in advance at the start of each billing period
• Prices are in Swiss Francs (CHF) and include applicable taxes where required
• Payment methods: credit card and Twint (Switzerland), processed via Stripe

Cancellation

• You can cancel your subscription at any time from Settings → Account
• Access to paid features continues until the end of the current billing period
• No refunds are issued for partial months or unused portions of a yearly subscription

Failed Payments

If a payment fails, we will notify you by email. Your subscription will be suspended if payment cannot be collected within a grace period. Your account data is retained and access is restored upon successful payment.

SpinMixPro and its underlying technology (rules engine, software, designs) are owned by balacoda GmbH. You are granted a limited, non-exclusive, non-transferable licence to use the service for your personal or professional playlist creation purposes.

Song metadata displayed in SpinMixPro (titles, artist names, BPM data) is sourced from third-party APIs (Deezer, GetSongBPM). We do not claim ownership of this data.

Playlists you generate and save are yours. You retain ownership of the playlist structure and configuration you create.

SpinMixPro is provided "as is" without warranties of any kind, express or implied. We do not guarantee:

• That the service will be uninterrupted or error-free
• That generated playlists will meet your specific artistic or training requirements
• The accuracy of BPM data sourced from third-party APIs

To the maximum extent permitted by Swiss law, our total liability to you for any claim arising from your use of SpinMixPro shall not exceed the amount you paid us in the 12 months preceding the claim.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or cause harm to the service or other users. In cases of serious violations, termination may be immediate without notice.

You may delete your account at any time from Settings → Account. Upon deletion, your personal data is removed in accordance with our Privacy Policy.

These Terms of Service are governed by the laws of Switzerland. Any disputes arising from these terms or your use of SpinMixPro shall be subject to the exclusive jurisdiction of the courts of the Canton of Zug, Switzerland.
